簡介:
陪審團制度目前大多只是在美國。


小陪審團--負責定事
美國憲法第6條修正案規定,被告有權與指控他或她的證人對質,並有權為獲得能為他或她辯護的證人而得到幫助。在所有的聯邦刑事案件及多數州民事案件中,被告會堅持由陪審團對這種正面對質做出裁決。最高法院於1968年做出解釋,說明陪審團制度適用於州的主要刑事案件。 在聯邦體系中,小型的或審判用的陪審團由12人組成 。州法院可以是6人,而且最高法院已規定──與州陪審團不同──如果州法律有規定;州刑事案陪審團可以根據「多數陪審員」的意見做出判決,而不必要一致同意。

大陪審團--負責起訴
第二種陪審團是大陪審團,可以是一個起訴或調查團體, 可以少至1人或者多至33人 。按照憲法第5條修正案的規定, 所有受到聯邦指控的死罪或其他「重罪」(
刑期在1年以上) 都必須首先由大陪審團起訴 。其他的聯邦指控及各州的犯罪都是提交到法院,陳述情況,由法院做出抉擇,從法官那裡得到對刑事案件提出指控的可能性的裁決。約半數的州有大陪審團,多數從事調查各類公眾問題或政府官員的行為,而不承擔指控。 他們可以提交用於指控某些具體人的報告,而並不實際起訴他們



歷史發展
陪審團作為一種制度在英國歷史上可追溯到數百年以前。 在大約1172年左右。亨利二世統治時期,它成為普通法體系的一部分,後於1215年被大憲法所承認。從那時起,建立了12人的標準,形成了地位相等的人組成陪審團的概念,產生了由大陪審團起訴的做法。從本質上講,陪審團是允許公眾進入司法程式的一項措施。州對某人的審判權透過一個由市民組成的小組體現出 來,這個小組決定被告的命運 。起初,這一程式的存在僅僅是為了排除國王和貴族對審判權的控制, 今天我們將地位相同的人組成陪審團」(憲法中並沒有提及,只是提到公正的陪審團)解釋為至少部分是在社會和經濟方面同被告有相同或相似背景的人組成的陪審團。大陪審團和小陪審團的成員一般都是從當地選舉人名單上選 出來的。某些職業,如醫生、律師、牧師、教師、護士、員警通常不讓擔當陪審團成員。在一些州,家庭主婦或任何婦女可以要求退出。辯方及起訴檢察官都有權不 說明理由而免除一定數目的陪審員資格,也可以以偏見為由免去其他陪審員。這樣做的結果是,陪審團幾乎從未代表人口組成情況,或是與被告地位相同的集團。


今天,無論是大陪審團還是小陪審團,都受到了抨擊。陪審團審判的方式正日漸消亡。許多人聲稱 只有消除陪審團審判才會有公正的審判。對陪審團行為的研究表明, 陪審團成員一般都被法官所左右,並且都強烈地傾向於相信被告可能有罪 。大陪審團也在考察之 列。1977年美國律師協會(American Bar Association)提出了一套改革方案,要求保護被大陪審團起訴的被告,包括賦予其律師辯護權,以及嚴格規定對拒不回答問題的被告的關押期限。這些 改革方案尚未由國會通過,但已在某些州逐漸地執行了。另一些州在實際上已經解散了大陪審團。
